This End User License Agreement (EULA) is a legal agreement made between Revolver Type Foundy / Lukas Schneider, Pieter-Valkenier-Allee 17, 64546 Mörfelden-Walldorf, Germany (from now on referred as 'Revolver Type Foundry') , and the end user/licensee (from now on referred as 'You').

STANDARD DESKTOP/PRINT - END USER LICENSE AGREEMENT (EULA)

1. PREAMBLE
Please read this document carefully before downloading, unpacking, installing and/or using revolver type foundry Font Software. By purchasing, downloading, accessing, installing or otherwise using the Font Software, you confirm that you have read, understood, and agreed to the terms of this Agreement.

This End User License Agreement (“Agreement”, “EULA”, “License” or “License Agreement”) is a binding legal agreement between you (“Licensee” or “End User”) and Revolver type foundry. By purchasing, downloading, accessing, installing or otherwise using the Font Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not purchase, access, install or otherwise use the Font Software.

For the purpose of this agreement, “Font Software” is defined as the digital typeface software made available to you by revolver type foundry, the type design embedded within the Font Software, any artwork, typeface, bitmaps or similar graphics created by the Font Software, any media, printed materials, electronic documentation, updates, upgrades, add-on components, or any other material that may be associated with the Font Software now or in the future.

2. LICENSE
Upon full payment, revolver type foundry grants you a non-exclusive, terminable license to use the Font Software. This license applies to the Font Software that has been purchased and is granted for the number of users and environment stated on the receipt/invoice. If at any time your use of the Font Software exceeds what is permitted under this license, you are required to inform revolver type foundry immediately and purchase the appropriate license upgrade.

3. USES AND RESTRICTIONS
You may not alter or copy the Font Software or the designs embodied therein in any manner. You may not reformat the Font Software into other formats for use in other operating systems, on the web, or in other applications. You may not change or adapt the design of the fonts/typefaces in the Font Software by adding, deleting, modifying, reverse engineering, extracting or in any other way tampering with the design or software, including, but not limited to, the metadata, the coding, and copyright notices in the Font Software.

The Font Software for desktop licensing is provided in OTF format. Additional formats and/or extensions are available upon request, and may require the purchase of supplemental licensing. Contact revolver type foundry for inquiries.

Use of revolver type foundry Font Software in any of the following manners is NOT permitted without written approval and the purchase of a License Upgrade from revolver type foundry:
a) alphabet or letterform-related products for resale, or letterform creation products or devices;
b) embedding in electronic devices; electronic books; all gaming uses and/or devices;
c) embedding in software;
d) storing and/or serving the font software for the purposes of making the font software available via the internet, regardless of the format or technology used.
e) in any film meant for theatrical release, television program, or broadcast via cable, satellite, or on the internet. You are permitted to use the Font Sofware in Flash animations.
f) use of the Font Software as the main element in goods for sale, such as t-shirts, mugs, on-demand stationary products, tattoos, stickers, etc. You are permitted this kind of use in editorial products such as magazines, newspapers and books.
g) installation of the font software on a server for serving to users.

Embedding of the Font Software is permitted for Portable Document Files (PDF), but only in such a way that the recipient cannot edit or extract the Font Software from the document. Furthermore, the Font Software may not be used to create or distribute any electronic document in which the Font Software or any part thereof, is embedded in a manner or format that permits editing, alterations, enhancements, or modifications by the recipient of such document.

You are permitted to make a temporary copy of the Font Software for use by a commercial printer or service bureau solely for use in the production of your own materials. You are permitted to include a temporary copy the Font Software with a document solely for the purposes of your facilitating your personal printing and/or viewing of the document, as long as you can ensure that such copy with be duly deleted. Otherwise, you are not permitted to make any other copies of the Font Software, documentation, or any parts thereof, except one (1) copy solely for backup purposes. Any such copy of the software shall contain the same propriety notice which appears on or in the original software.

If you are a design consultancy, advertising agency, or a designer working on behalf of a client, the ultimate end user (your client) must also purchase a License for the intended use of the Font Software, if their use of the Font Software will exceed what is permitted in this Agreement.

If you are unsure whether your use of the Font Software is specifically permitted under this Agreement, contact revolver type foundry.

4. COPYRIGHT
revolver type foundry retains all rights and title to the Font Software, together with the designs, the trademarks, and the copyrights embodied in the Font Software. By agreeing to this EULA you agree not to copy the Font Software or create derivative works based upon the design of the Font Software. You agree that the design of the Font Software is the exclusive (intellectual) property of revolver type foundry and that the unauthorized use of the design of the Font Software is an infringement upon revolver type foundry’ exclusive rights causing significant monetary harm. All rights not expressly granted herein are reserved to revolver type foundry.

5. TRANSFER OF LICENSE
You expressly agree not to rent, lease, sublicense, give, lend, or further distribute the Font Software. You may transfer all your rights under this Agreement to another person or entity, one (1) time only, provided that (I) the transferee accepts and agrees to be bound by all the terms and conditions of this Agreement, (II) you destroy all copies of the Font Software, including all copies stored in the memory of a hardware device and (III) you inform Revolver type foundry about the transfer of License.

6. TERMINATION
This License Agreement is effective as of the date of full payment for the License until terminated. This Agreement will terminate automatically if you fail to comply with any provision contained herein. Upon termination, you must immediately destroy the Font Software together with any documentation and printed material, as well as any copies of the Font Software or parts of it.

The unauthorized sharing, lending, renting, sale, or other unauthorized use or misuse of the back-up copy is a material breach of this Agreement and will result in the immediate termination of this License.

7. DISCLAIMER & LIMITATION OF LIABILITY
revolver type foundry will replace the Font Software in the event the Font Software does not perform substantially in accordance with the documentation provided that any such claim is submitted within twentyone (21) days from the date of delivery, as shown on your receipt.

The Font Software is provided ‘as is’. The entire risk as to the quality and performance of the Font Software rests upon you. Except for the limited warranty stated in the previous paragraph, revolver type foundry disclaims all warranties, representations and guarantees, express or implied, as to fitness for any particular purpose, merchantability or otherwise with respect to the Font Software. revolver type foundry does not warrant that the operation of the Font Software will be uninterrupted or error-free, or that the Font Software is without defects.

revolver type foundry shall not be liable for any injury, damage, any direct or indirect financial or economic loss, loss of profits, legal costs or any other cost, injury or damage whatsoever as the result of the use, installation, dispersion, or communication of the font software supplied by revolver type foundry. revolver type foundry is not liable for any viruses, bugs, errors or similar. revolver type foundry’s liability to pay any kind of damages under German law is under all circumstances limited to the price paid for the goods supplied or replacement of the Font Software, either of which shall be at Revolver type foundry’s sole discretion. You agree to indemnify and hold revolver type foundry harmless from and against any claims or damage which may result from your breach of this license agreement. revolver type foundry grants the rights of use of purchased Font Software to you in good faith, and requests that you adhere to the terms of this agreement to the best of your ability, and in good faith.

8. GOVERNING LAW
This Agreement shall be governed, enforced, and construed in accordance to the laws of Germany as they apply to contracts entered into and wholly performed therein. Any dispute arising from the selling and purchasing of goods from revolver type foundry shall be settled according to German law.

9. OTHER
You acknowledge to be bound by the terms and conditions of this EULA and further agrees that the EULA is the complete and exclusive statement of the agreement between revolver type foundry and the purchaser which supersedes any prior proposal, prior agreement (oral or in writing) and any other communications relating to the subject matter of this EULA. No variation of the terms of this agreement or any different terms will be enforceable in the absence of an express written amendment signed by an authorized officer of revolver type foundry. The failure of revolver type foundry to insist upon strict adherence to any term of this EULA on any occasion shall not be construed as a waiver and shall not deprive Revolver type foundry of the right thereafter to insist upon strict adherence to that term or any other term of this EULA.

WEBFONTS FOR SELF HOSTING - END USER LICENSE AGREEMENT (EULA)

1. PREAMBLE
Please read this document carefully before downloading, unpacking, installing and/or using revolver type foundry Font Software. By using this Font Software, you confirm that you have read, understood, and agreed to the terms of this Agreement.

This End User License Agreement for Web use (“License”, “Agreement”, “EULA” or “Web License Agreement”) is a binding legal agreement between you (“Licensee”) and revolver type foundry. By purchasing, downloading, accessing, installing or otherwise using the Font Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not purchase, access, install or otherwise use the Font Software.

For the purpose of this Agreement, “Font Software” is defined as the digital typeface software made available to you by revolver type foundry, the type design embedded within the Font Software, any artwork, typeface, bitmaps or similar graphics created by the Font Software, any media, printed materials, electronic documentation, updates, upgrades, add-on components, or any other material that may be associated with the Font Software now or in the future. A Webfont is Font Software that has been created, optimised, translated or otherwise specially modified for use on the Internet for styling or viewing text on a website.

2. LICENSE
Upon payment of the usage fee, you are granted the non-exclusive right to use the purchased Webfonts according to the terms and conditions of this EULA.

You are permitted to use the licensed Webfonts on one (1) domain only, with a maximum of three (3) subdomains. The domain is stated on your receipt/invoice. You are not permitted to serve the Webfonts to multiple website domains. If you require the use of the same Webfonts across multiple domains, place a different order for each one. Additionally, Webfonts may not be served to unlicensed domains, even if they are hosted on a licensed domain.

revolver type foundry Webfonts are licensed and priced according to page-views per month. You must monitor your domain’s page-views regarding to the amount of page-views stated on your receipt/invoice. If the amount of page-views of your website exceeds the number stated on your receipt/invoice for three (3) months in a row, you are required to extend your License accordingly by contacting revolver type foundry. The Payment for a Web-Font License is a one-time fee unless you need to extend your License because the page-views of your website increase. Exceptions are stated on your receipt/invoice.

The Webfonts are provided in TTF, WOFF, WOFF2 and EOT formats. Additional formats are available upon request, and may require the purchase of supplemental licensing. Contact revolver type foundry for inquiries.

3. USES AND RESTRICTIONS
The Webfonts may only be used for styling text on your website via the CSS @font-face rule exclusively for the domain specified on your receipt/invoice. You are responsible for hosting the Webfonts securely, such that third parties cannot easily extract/download them or parts of them from your website. revolver type foundry cannot support technical or design issues when you are using Webfonts.

Viewing and printing pages of the website using the Webfonts is allowed. Providing the ability for a remote user to edit text using the Webfonts is not allowed. The webfonts are meant for conventional websites, not editable documents.

You are not permitted to make any copies of the Webfonts, documentation, or any parts thereof, except one (1) copy solely for backup purposes. Any such copy of the software shall contain the same propriety notice which appears on or in the original software.

You may not alter or copy the Webfonts or the designs embodied therein in any manner. You may not use conversion or editing tools on the Webfonts. You may not change or adapt the design of the fonts/typefaces in the Webfonts by adding, deleting, modifying, reverse engineering, extracting or in other way tampering with the design or software, including, but not limited to, the metadata, the coding, and copyright notices in the Font Software.

You may use the Webfonts only via the conventional @font-face CSS declaration. You may not use other technologies, such as sIFR, Cufon, or Typeface.js, to serve or display the fonts.

The use of the Webfonts is restricted to the use in websites. Should you wish to embed or include revolver type foundry Webfonts or the designs forming the Webfonts, in software, hardware, mobile apps, applications, devices, or any kind of stand-alone software/hardware, additional licensing is required and you must contact revolver type foundry for an additional license.

If you are unsure whether your use of the Webfonts is specifically permitted under this Agreement, contact revolver type foundry.

6. TERMINATION
This License Agreement is effective as of the date of full payment for the license until terminated. If you fail to comply with any provision contained in this Agreement, revolver type foundry has the right to set a deadline of 20 days for you to bring yourself into compliance with the agreement. If you will not bring yourself into compliance with the Agreement within 20 days, revolver type foundry has the right to terminate the Agreement. Upon termination, you must immediately destroy the Font Software together with any documentation and printed material, as well as any copies of the Font Software or parts of it.

7. DISCLAIMER, LIMITED WARRANTY & LIMITATION OF LIABILITY
revolver type foundry has done everything they can to produce their fonts to the highest and most up-to-date technical standards. revolver type foundry warrants that the Font Software will perform substantially in accordance with its specifications (e.g. platform compatibility, character set specifications, OpenType features specifications, and any other features that may be specified on the revolver type foundry website in relation to the purchased Font Software). The revolver type foundry will replace the Font Software in the event the Font Software does not perform substantially in accordance with these specifications that any such claim is submitted within twentyone (21) days from the date of delivery, as shown on your receipt. The Font Software is provided ‘as is’. The entire risk as to the quality and performance of the Font Software rests upon you. Except for the limited warranty stated in the previous paragraph, revolver type foundry disclaims all warranties, representations and guarantees, express or implied, as to fitness for any particular purpose, merchantability or otherwise with respect to the Font Software. revolver type foundry does not warrant that the operation of the Font Software will be uninterrupted or error-free, or that the Font Software is without defects.

revolver type foundry shall not be liable for any injury, damage, any direct or indirect financial or economic loss, loss of profits, legal costs or any other cost, injury or damage whatsoever as the result of the use, installation, dispersion, or communication of the font software supplied by revolver type foundry. revolver type foundry is not liable for any viruses, bugs, errors or similar. revolver type foundry’s liability to pay any kind of damages under German law is under all circumstances limited to the price paid for the goods supplied or replacement of the Font Software, either of which shall be at Revolver type foundry’s sole discretion. 9. OTHER
You acknowledge to be bound by the terms and conditions of this EULA and further agrees that the EULA is the complete and exclusive statement of the agreement between revolver type foundry and the purchaser which supersedes any prior proposal, prior agreement (oral or in writing) and any other communications relating to the subject matter of this EULA. No variation of the terms of this agreement or any different terms will be enforceable in the absence of an express written amendment signed by an authorized officer of revolver type foundry. The failure of revolver type foundry to insist upon strict adherence to any term of this EULA on any occasion shall not be construed as a waiver and shall not deprive revolver type foundry of the right thereafter to insist upon strict adherence to that term or any other term of this EULA.

FONT SOFTWARE FOR MOBILE APPLICATIONS - END USER LICENSE AGREEMENT (EULA)

This End User License Agreement for Mobile Applications use (“License”, “Agreement”, “App EULA” or “App License Agreement”) is a binding legal agreement between you (“Licensee”) and the revolver type foundry. By purchasing, downloading, accessing, installing or otherwise using the Font Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not purchase, access, install or otherwise use the Font Software.

2. LICENSE
Upon payment of the usage fee, you are granted the non-exclusive right to use the purchased Font Software according to the terms and conditions of this App EULA.

The Font Software for mobile applications licensing is provided in TTF format. Additional formats and/or extensions are available upon request, and may require the purchase of supplemental licensing. Contact revolver type foundry for inquiries.

3. USES AND RESTRICTIONS
revolver type foundry Font Software is licensed and priced according to the number of Apps you want to embed the Font Software in. The maximum number of distinct Apps that this License allows you to embed the Font Software in is indicated on your receipt/invoice. For clarity, if you distribute an App on multiple software platforms (iOS, Android, etc), each version is regarded as a separate App under this License.

You may:
(a) embed the Font Software into an iOS, Android or Windows Phone Application ;
(b) embed the Font Software: in a secure manner which does not allow an End User to access the Font Software outside of the Application;
(c) embed the Font Software in all subsequent updates of the same App, as long as the core functionality is not altered and the App can reasonably be considered to be the same product;
(d) temporarily install one (1) copy of the Font Software on your desktop operating system for the purposes of testing your App or making design comps.

You may not:
(a) redistribute the Font with the App’s source code;
(b) install the Font Software inside the operating system the App runs on;
(c) embed the Font Software in an App that enables an end user to create custom typesetting with the said Font Software or parts of it. “Custom typesetting” includes but is not limited to an App that outputs PDFs, spreadsheets, word processing documents, labels, static or moving images, advertisements, or any other documents using the Font Software. You may, as an exception, embed the Font Software in reports that the App saves or exports, provided that the reports are not sold for profit.
(d) embed the Font Software in an App where the Font Software is the primary attraction or represents a large part of the functionality of the App into which it is being embedded (for example, a type specimen App);
(e) embed the Font Software in an App that you plan to make open source or suspect might become open source.

You are not permitted to make any copies of the Font Software, documentation, or any parts thereof, except one (1) copy solely for backup purposes. Any such copy of the software shall contain the same propriety notice which appears on or in the original software. You may not alter or copy the Font Software or the designs embodied therein in any manner. You may not use conversion or editing tools on the Font Software. You may not change or adapt the design of the fonts/typefaces in the Font Software by adding, deleting, modifying, reverse engineering, extracting or in other way tampering with the design or software, including, but not limited to, the metadata, the coding, and copyright notices in the Font Software.

The use of the Font Software is restricted to the use in Mobile Applications. Should you wish to embed or include revolver type foundry Font Software or the designs forming the Font Software, in print, websites, hardware, operating systems, broadcasting, or any other usage not specifically permitted in this License, additional licensing is required and you must contact revolver type foundry for an additional license.

4. COPYRIGHT

FONT SOFTWARE FOR ELECTRONIC PUBLICATIONS - END USER LICENSE AGREEMENT (EULA)

This End User License Agreement for Electronic Publications use (“License”, “Agreement”, “ePub EULA”, or “ePub License Agreement”) is a binding legal agreement between you (“You” or “Licensee”) and revolver type foundry. By purchasing, downloading, accessing, installing or otherwise using the Font Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not purchase, access, install or otherwise use the Font Software.

“Electronic Publication” (“ePub”) means a collection of text and graphics in electronic form, such as but not limited to eBook, eMagazine, eNewspaper, ePaper, ePublication, interactive PDFs, which is intended for consumption by an end user (the individual or entity, which downloads an ePub on a device).

2. LICENSE
Upon payment of the usage fee, you are granted the non-exclusive right to use the purchased Font Software according to the terms and conditions of this ePub EULA.

revolver type foundry Font Software is licensed and priced according to the number of ePubs you want to embed the Font Software in. The maximum number of distinct ePubs that this License allows you to embed the Font Software in is indicated on your receipt/invoice. For clarity, reasonable regional or format variations of an ePub shall not count as a separate ePub. However, subsequent issues of a publication, new editions, and similar major revisions shall count as a separate ePub, and a new License will have to be purchased.

3. USES AND RESTRICTIONS
The Font Software must be embedded within an archive file format that protects the Font Software by means of compression, encryption or obfuscation. Formats that meet these criteria include, but are not limited to, PDF, EPUB 2.01, EPUB 3, and KF8. The ePub must be a non-executable file which is displayed by e-reader software or on e-reader devices. The Font Software may not be installed in the operating system on which the ePub runs.

You may temporarily install one (1) copy of the Font Software on your desktop operating system for the purposes of testing your ePub or making design comps. You are otherwise not permitted to make any copies of the Font Software, documentation, or any parts thereof, except one (1) copy solely for backup purposes. Any such copy of the software shall contain the same propriety notice which appears on or in the original software.

You may not alter or copy the Font Software or the designs embodied therein in any manner. You may not use conversion or editing tools on the Font Software. You may not change or adapt the design of the fonts/typefaces in the Font Software by adding, deleting, modifying, reverse engineering, extracting or in other way tampering with the design or software, including, but not limited to, the metadata, the coding, and copyright notices in the Font Software.

revolver type foundry has done everything they can to produce their fonts to the highest and most up-to-date technical standards. revolver type foundry warrants that the Font Software will perform substantially in accordance with its specifications (e.g. platform compatibility, character set specifications, OpenType features specifications, and any other features that may be specified on the revolver type foundry website in relation to the purchased Font Software) revolver type foundry will replace the Font Software in the event the Font Software do not perform substantially in accordance with these specifications that any such claim is submitted within twentyone (21) days from the date of delivery, as shown on your receipt. The Font Software are provided ‘as is’. The entire risk as to the quality and performance of the Font Software rests upon you. Except for the limited warranty stated in the previous paragraph, revolver type foundry disclaims all warranties, representations and guarantees, express or implied, as to fitness for any particular purpose, merchantability or otherwise with respect to the Font Software. revolver type foundry does not warrant that the operation of the Font Software will be uninterrupted or error-free, or that the Font Software are without defects.

revolver type foundry shall not be liable for any injury, damage, any direct or indirect financial or economic loss, loss of profits, legal costs or any other cost, injury or damage whatsoever as the result of the use, installation, dispersion, or communication of the Font Software supplied by revolver type foundry. revolver type foundry is not liable for any viruses, bugs, errors or similar. revolver type foundry’s liability to pay any kind of damages under German law is under all circumstances limited to the price paid for the goods supplied or replacement of the Font Software, either of which shall be at revolver type foundry’s sole discretion. You agree to indemnify and hold the revolver type foundry harmless from and against any claims or damage which may result from your breach of this license agreement. revolver type foundry grants the rights of use of purchased Font Software to you in good faith, and requests that you adhere to the terms of this agreement to the best of your ability, and in good faith.

9. OTHER
You acknowledge to be bound by the terms and conditions of this EULA and further agrees that the EULA is the complete and exclusive statement of the agreement between revolver type foundry and the purchaser which supersedes any prior proposal, prior agreement (oral or in writing) and any other communications relating to the subject matter of this EULA. No variation of the terms of this agreement or any different terms will be enforceable in the absence of an express written amendment signed by an authorized officer of revolver type foundry. The failure of revolver type foundry to insist upon strict adherence to any term of this EULA on any occasion shall not be construed as a waiver and shall not deprive revolver type foundry of the right thereafter to insist upon strict adherence to that term or any other term of this EULA.

By purchasing a full license of LS CADENCER TOOLS you agree with the following:

Redistribution in source and binary forms, with or without modification, is not permitted.
You also agree not to change the LS Cadencer and LS Cadenculator scripts, nor to adapt the extensions/plugins in any way, or convert or port them to other applications. You agree not to create derivative works of the extensions/plugins. You agree not to change or modify the extensions/plugins' trademarked names in any form or manner. These tools are copyrighted, as are the underlying patterns.

Diese Endnutzer Lizenzvereinbarung (EULA) ist eine rechtlich bindende Vereinbarung der Revolver Type Foundy / Lukas Schneider, Pieter-Valkenier-Allee 17, 64546 Mörfelden-Walldorf, Deutschland (nachfolgend 'Revolver Type Foundry' genannt)

STANDARD DESKTOP/PRINT - ENDNUTZER LIZENZVEREINBARUNG

1. PRÄAMBEL
Bitte lesen Sie dieses Dokument, bevor Sie die Font-Software herunterladen, entpacken, installieren und/oder verwenden, sorgfältig durch. Durch den Kauf, Download, Zugriff, Installation oder anderweitige Verwendung der Font-Software bestätigen Sie, dass Sie die Bedingungen dieser Vereinbarung gelesen, verstanden und akzeptiert haben.

Diese Endnutzer-Lizenzvereinbarung („Vereinbarung“, „Lizenz“, „Lizenzvereinbarung“) ist eine rechtlich bindende Vereinbarung zwischen Ihnen („Lizenznehmer“ oder „Endnutzer“) und der Revolver Type Foundry. Durch Erwerb, Download, Zugriff, Installation oder anderweitige Verwendung der Font-Software erklären Sie sich mit den Bedingungen dieser Vereinbarung einverstanden. Wenn Sie den Bedingungen dieser Vereinbarung nicht zustimmen, dürfen Sie die Font-Software nicht kaufen, darauf zugreifen, sie installieren oder anderweitig verwenden.

Im Sinne dieser Vereinbarung steht der Begriff „Font-Software“ für die digitale Schrift-Software, die Ihnen von der Revolver Type Foundry zur Verfügung gestellt wird. Zur Font-Software gehört außerdem das in die Font-Software eingebettete Schriftdesign, jegliche Art von Grafiken, Schriften, Bitmaps oder ähnliche Grafik-Medien, gedruckte Materialien, elektronische Dokumentationen, Updates, Upgrades, Zusatzkomponenten oder jedes andere Material, das mit der Font-Software jetzt oder in Zukunft in Verbindung gebracht werden kann.

2. LIZENZ
Bei vollständiger Bezahlung gewährt Ihnen die Revolver Type Foundry eine nicht-exklusive, kündbare Lizenz zur Verwendung der Font-Software. Diese Lizenz für die erworbene Font-Software wird für die auf der Rechnung angegebene Anzahl von Benutzern und Nutzungs-Umgebung(en) gewährt. Wenn zu irgendeinem Zeitpunkt Ihre Nutzung der Font-Software die unter dieser Lizenz gewährten Parameter überschreitet, sind Sie verpflichtet die Revolver Type Foundry unverzüglich zu informieren und das entsprechende Lizenz-Upgrade erwerben.

3. ANWENDUNGSBEREICHE UND BESCHRÄNKUNGEN
Der Lizenznehmer darf die Font-Software oder die darin enthaltenen digitalen Designs in keiner Weise verändern oder kopieren. Der Lizenznehmer darf die Font-Software nicht in andere Formate konvertieren oder umformatieren, um sie für die Verwendung in anderen Betriebssystemen, im Internet oder in anderen Anwendungen nutzbar zu machen. Dem Lizenznehmer ist es nicht gestattet das Design der Fonts/Schriften in der Font Software zu verändern oder anzupassen, indem dem Design oder der Software, Teile hinzufügt, gelöscht, modifiziert, rück-konvertiert („Reverse Engineering“), extrahiert oder auf andere Weise manipuliert werden. Dies beinhaltet auch die Metadaten, die Kodierung und Copyright-Hinweise und alle anderen Bereiche in der Font-Software.

Die Font-Software für die Desktop-Lizenz wird im .otf Format bereitgestellt. Weitere Datei-Formate (wie z.b. TrueType/.ttf Format) und Erweiterungen sind auf Anfrage erhältlich und erfordern möglicherweise den Erwerb zusätzlicher Lizenzen. Bitte kontaktieren Sie die Revolver Type Foundry für solche Anfragen.

Die Verwendung der Font-Software ist für folgende Arten der Anwendung ohne schriftliche Genehmigung und den Erwerb eines Lizenz-Upgrades der Revolver Type Foundry NICHT erlaubt:
a) Alphabete oder Buchstaben bezogene Produkte für den Wiederverkauf oder Geräte die für die Herstellung von Buchstaben bestimmt sind.
b) das Einbetten in elektronische Geräte, elektronische Bücher, digitale Spiele oder digitale Spiel-Geräte.
c) das Einbetten in Software.
d) die Bereitstellung der Font-Software über das Internet, unabhängig vom verwendeten Format oder der verwendeten Technologie.
e) die Nutzung in jeder Art von Film, der für das Kino, das Fernsehprogramm oder die Übertragung über Kabel, Satellit oder im Internet gedacht ist. Die Font-Software darf in Flash-Animationen verwendet werden.
f) die Nutzung der Font-Software als Hauptbestandteil von Waren zum Verkauf, wie z.B. T-Shirts, Tassen, Schreibwaren, Tätowierungen, Aufkleber usw.
Erlaubt ist die Verwendung in redaktionellen Produkten wie Zeitschriften, Zeitungen, Zeitschriften und Büchern.
g) die Installation der Font-Software auf einem Server, um sie für Benutzer verfügbar zu machen.

Die Einbettung der Font-Software ist für Portable Document Files (PDF) erlaubt, jedoch nur so, dass der Empfänger die Font-Software nicht bearbeiten oder aus dem Dokument extrahieren kann. Darüber hinaus darf die Font-Software nicht zum Erstellen oder Verteilen elektronischer Dokumente, in denen die Font-Software oder Teile davon in einer Art und Weise eingebettet ist, die eine Bearbeitung, Änderung, Erweiterung oder Modifikation durch den Empfänger eines solchen Dokuments ermöglicht, verwendet werden.

Sie dürfen eine temporäre Kopie der Font-Software zur Verwendung durch ein kommerzielles Drucker- oder Serviceunternehmen ausschließlich für die Herstellung Ihrer eigenen Materialien erstellen. Sie dürfen eine temporäre Kopie der Schriften-Software mit einem Dokument nur zur Erleichterung des Druckenvorgangs und/oder Betrachtens des Dokuments verwenden, solange Sie sicherstellen können, dass diese Kopie ordnungsgemäß gelöscht wird. Ansonsten ist es Ihnen nicht gestattet, weitere Kopien der Font-Software, Dokumentation oder Teile davon zu erstellen, mit Ausnahme einer (1) Kopie ausschließlich für Sicherungszwecke. Eine Kopie der Software muss den gleichen Eigentumshinweis beinhalten, der in der Originalsoftware enthalten ist.

Wenn Sie eine Design-, Werbe-Agentur oder ein Designer sind, der im Auftrag eines Kunden arbeitet, muss der Endnutzer (Ihr Kunde), wenn die in dieser Lizenz-Vereinbarung erlaubten Verwendungsweisen der Font-Software überschritten werden, ebenfalls eine Lizenz für die beabsichtigte Nutzung der Font-Software erwerben.

Wenn Sie nicht sicher sind, ob Ihre Nutzung der Font-Software im Rahmen dieser Lizenz-Vereinbarung ausdrücklich erlaubt ist, wenden Sie sich an die Revolver Type Foundry.

4. URHEBERRECHT/COPYRIGHT
Die Revolver Type Foundry behält alle Rechte und Titel der Font-Software, zusammen mit den Designs, den Warenzeichen und den Urheberrechten, die in der Font-Software enthalten sind. Durch die Zustimmung zu dieser Endnutzer-Lizenzvereinbarung stimmt der Lizenznehmer zu, die Font-Software nicht zu kopieren oder Derivate zu erstellen, die auf dem Design der Font-Software basieren. Der Lizenznehmer stimmt zu, dass das Design der Font-Software das ausschließliche (geistige) Eigentum der Revolver Type Foundry ist und dass die unautorisierte Verwendung des Designs der Font-Software eine Verletzung der exklusiven Rechte der Revolver Type Foundry darstellt, welche erhebliche finanzielle Schäden verursacht. Alle hier nicht ausdrücklich gewährten Rechte sind der Revolver Type Foundry vorbehalten.

5. ÜBERTRAGUNG DER LIZENZ
Der Lizenznehmer stimmen ausdrücklich zu, die Font-Software nicht zu vermieten, zu unterlizenzieren, zu vergeben, zu verleihen oder weiter zu vertreiben. Der Lizenznehmer kann alle Rechte aus dieser Vereinbarung an eine andere Person oder Organisation übertragen, und zwar nur einmal (1), vorausgesetzt, dass (I) derjenige, an den die Lizenz übertragen wird, alle Bedingungen dieser Vereinbarung annimmt und sich damit einverstanden erklärt, (II) der Lizenznehmer alle Kopien der Font-Software, einschließlich aller Kopien, die im Speicher eines Hardwaregeräts gespeichert sind, löscht beziehungsweise vernichtet und (III) der Lizenznehmer die Revolver Type Foundry über die Lizenzübertragung informiert.

6.BEENDIGUNG DER LIZENZ
Diese Lizenzvereinbarung gilt ab dem Datum der vollständigen Bezahlung der Lizenz bis zur Beendigung bzw. Kündigung der Lizenz. Diese Lizenzvereinbarung endet automatisch, wenn der Lizenznehmer die darin enthaltenen Bestimmungen nicht einhält. Bei Beendigung muss der Lizenznehmer die Font-Software unverzüglich zusammen mit jeglicher Dokumentation und gedrucktem Material sowie allen Kopien der Font-Software oder Teilen davon vernichten.

Das unerlaubte Bereitstellen, der Verleih, das Vermieten, der Verkauf oder ein anderer unbefugter Gebrauch oder Missbrauch der Sicherungskopie stellt eine wesentliche Verletzung dieser Vereinbarung dar und führt zur sofortigen Beendigung dieser Lizenz.

7. HAFTUNGSAUSSCHLUSS UND HAFTUNGSBESCHRÄNKUNG
Die Revolver Type Foundry wird die Font Software ersetzen, falls die Font Software nicht im Wesentlichen gemäß der Dokumentation funktioniert, vorausgesetzt, dass eine solche Reklamation innerhalb von einundzwanzig (21) Tagen ab dem Datum welches auf Ihrer Rechnung angegeben ist, eingereicht wird.

Die Font-Software wird in der vorliegenden Form ohne jegliche Gewährleistung zur Verfügung gestellt. Das gesamte Risiko hinsichtlich der Qualität und Leistung der Font-Software liegt beim Lizenznehmer. Mit Ausnahme der beschränkten Garantie, die im vorherigen Absatz erwähnt wurde, lehnt Revolver Type Foundry alle Gewährleistungen, Zusicherungen und Garantien ab, die ausdrücklich oder stillschweigend für die Eignung für einen bestimmten Zweck, die Marktgängigkeit oder anderweitig in Bezug auf die Font-Software gelten. Die Revolver Type Foundry garantiert nicht, dass der Betrieb der Font-Software ununterbrochen oder fehlerfrei funktioniert oder dass die Font-Software ohne Fehler ist.

Die Revolver Type Foundry haftet nicht für jegliche Verletzungen, Schäden, direkte oder indirekte finanzielle oder wirtschaftliche Verluste, entgangene Gewinne, Rechtskosten oder sonstige Kosten, Verletzungen oder Schäden, die sich aus der Verwendung, Installation, Verbreitung oder Kommunikation ergeben der Schriftart-Software, die von der Revolver Type Foundry geliefert wird. Die Revolver Type Foundry haftet nicht für Viren, Softwarefehler, Fehler oder ähnliches. Die Haftung der Revolver Type Foundry für Schadenersatz nach deutschem Recht beschränkt sich in jedem Fall ausschließlich auf den Preis, der für die gelieferten Waren oder den Ersatz der Font-Software. Welche der beiden liegt im alleinigen Ermessen der Revolver Type Foundry. Der Lizenznehmer erklärt sich damit einverstanden, die Revolver Type Foundry von jeglichen Ansprüchen und Schäden, die sich aus einem Verstoß des Lizenznehmers gegen diese Lizenzvereinbarung ergeben könnten, schadlos zu halten. Die Revolver Type Foundry gewährt dem Lizenznehmer in gutem Glauben die Nutzungsrechte an der erworbenen Font-Software und bittet den Lizenznehmer, die Bedingungen dieser Lizenz-Vereinbarung nach bestem Wissen und Gewissen einzuhalten.

8. GELTENDES RECHT
Diese Lizenz-Vereinbarung wird in Übereinstimmung mit den in der Bundesrepublik Deutschland geltenden Gesetzen für abgeschlossene und vollständig erfüllte Verträge, geregelt, durchgesetzt und ausgelegt.
Für Streitigkeiten die auf den Verkauf und Kauf von Gütern der Revolver Type Foundry zurückzuführen sind, gilt das Recht der Bundesrepublik Deutschland.

9. SONSTIGES
Sie erkennen hiermit an, die Bedingungen dieses Endnutzer-Lizenzvereinbarung zu akzeptieren und stimmen weiterhin zu, dass diese Lizenzvereinbarung die vollständige und ausschließliche Vereinbarung zwischen der Revolver Type Foundry und dem Käufer darstellt, und diese alle vorherigen (mündliche oder schriftliche) Vereinbarungen und sonstige Mitteilungen in Bezug auf den Gegenstand dieser Endnutzer-Lizenzvereinbarung ersetzt. Änderungen dieser Vereinbarung oder anderer Bedingungen dieser Vereinbarung müssen schriftlich verfasst und von einem autorisierten Vertreter der Revolver Type Foundry unterzeichnet werden. Das Versäumnis der Revolver Type Foundry auf die strikte Einhaltung einer Klausel dieser Endnutzer-Lizenzvereinbarung hinzuweisen, darf nicht als Verzicht ausgelegt werden und soll der Revolver Type Foundry nicht das Recht nehmen, zu verlangen, dass diese oder eine andere Klausel dieser Endnutzer-Lizenzvereinbarung eingehalten werden muss.

WEBFONTS SELF HOSTING - ENDNUTZER LIZENZVEREINBARUNG

1. PRÄAMBEL
Bitte lesen Sie dieses Dokument, bevor Sie die Font-Software herunterladen, entpacken, installieren und/oder verwenden, sorgfältig durch. Durch die Verwendung der Font-Software bestätigen Sie, dass Sie die Bedingungen dieser Vereinbarung gelesen, verstanden und akzeptiert haben.

Diese Endnutzer-Lizenzvereinbarung („Vereinbarung“, „Lizenz“, „Lizenzvereinbarung“, “Web Lizenzvereinbarung ”) ist eine rechtlich bindende Vereinbarung zwischen Ihnen („Lizenznehmer“ oder „Endnutzer“) und der Revolver Type Foundry. Durch Erwerb, Download, Zugriff, Installation oder anderweitige Verwendung der Font-Software erklären Sie sich mit den Bedingungen dieser Vereinbarung einverstanden. Wenn Sie den Bedingungen dieser Vereinbarung nicht zustimmen, dürfen Sie die Font-Software nicht kaufen, darauf zugreifen, sie installieren oder anderweitig verwenden.

2. LIZENZ
Nach Zahlung der Nutzungsgebühr gewährt Ihnen die Revolver Type Foundry eine nicht-exklusive Lizenz die es dem Lizenznehmer erlaubt die erworbenen Web-Fonts gemäß den in dieser Lizenzvereinbarung enthaltenen Bedingungen zu nutzen.

Der Lizenznehmer darf die lizenzierten Web-Fonts für eine (1) Domain mit maximal drei (3) Subdomains verwenden. Der Domain-Name ist auf der Rechnung des Lizenznehmers vermerkt. Die Web-Fonts dürfen nicht für mehrere Website-Domains verwendet werden. Wenn der Lizenznehmer die Web-Fonts für mehrere Domains nutzen möchte, so muss für jede Domain eine eigene Lizenz erworben werden. Darüber hinaus dürfen die Web-Fonts nicht für unlizenzierte Domains bereitgestellt, auch wenn die Web-Fonts in einer lizenzierten Domain gehostet werden.

Der Preis für eine Web-Font Lizenz berechnet sich anhand der Seitenaufrufe („page-views“) der Website pro Monat. Die maximale Anzahl der Seitenaufrufe („page-views“) pro Monat ist auf ihrer Rechnung vermerkt. Die Anzahl der Seitenaufrufe („page-views“) ihrer Domain muss hinsichtlich der Web-Font Lizenz abgeglichen werden. Wenn die Anzahl der Seitenaufrufe („page-views“) ihrer Website die auf ihrer Rechnung angegebene Anzahl von Seitenaufrufen („page-views“) drei (3) aufeinanderfolgende Monate überschreitet, müssen Sie ihre bestehende Lizenz entsprechend erweitern, indem Sie sich an die Revolver Type Foundry wenden. Die Zahlung einer Web-Font Lizenz ist eine einmalige Gebühr, es sei denn, der Lizenznehmer muss die Lizenz erweitern, da sich die monatlichen Seitenaufrufe („page-views“) erhöhen. Ausnahmen sind auf ihrer Rechnung vermerkt.

Die Web-Fonts werden in den Formaten TTF, WOFF, WOFF2 und EOT bereitgestellt. Zusätzliche Formate sind auf Anfrage erhältlich und erfordern möglicherweise den Erwerb zusätzlicher Lizenzen. Bitte kontaktieren Sie die Revolver Type Foundry wenn Sie andere Dateiformate benötigen oder Fragen dazu haben.

3. ANWENDUNGSBEREICHE UND BESCHRÄNKUNGEN
Die Web-Fonts dürfen ausschließlich zum Formatieren bzw. Gestalten von Text auf Ihrer Website über die CSS @font-face Regel eingebettet und ausschließlich für die auf der Rechnung angegebene Domain verwendet werden. Sie sind dafür verantwortlich, die Web-Fonts sicher zu hosten, sodass Dritte die Web-Fonts oder Teile davon nicht einfach von Ihrer Website extrahieren oder herunterladen können. Die Revolver Type Foundry leistet keinen Support für technische oder designbezogenen Probleme zur Verwendung der Web-Fonts.

Das Anzeigen und Drucken von Seiten der Website, die mit den Web-Fonts gestaltet sind, ist grundsätzlich zulässig. Nicht zulässig ist es dem Nutzer der Website die Möglichkeit zu bieten den Text mit den verwendeten Web-Fonts zu bearbeiten. Die Web-Fonts sind für konventionelle Webseiten gedacht und nicht für editierbare Dokumente.

Es ist dem Lizenznehmer nicht gestattet, Kopien der Web-Fonts, Dokumentation oder Teile davon zu erstellen, mit Ausnahme einer (1) Kopie ausschließlich für Sicherungszwecke. Eine Kopie der Software muss den gleichen Eigentumshinweis beinhalten, der in der Originalsoftware enthalten ist.

Der Lizenznehmer darf die Web-Fonts oder die darin enthaltenen Designs in keiner Weise verändern oder kopieren. Die Web-Fonts dürfen nicht mit einer Konvertierungs- oder Bearbeitungs-Software weiterverarbeitet werden. Das Design der Schriften/Fonts in den Web-Fonts darf nicht durch Hinzufügen, Löschen, Modifizieren, Reverse Engineering, Extrahieren oder in sonstiger Weise durch Manipulation des Designs oder der Software verändert oder angepasst werden. Dies gilt auch für alle anderen Teile der Font-Software, wie beispielsweise für die Metadaten, die Codierung und die Copyright-Hinweise in der Font-Software.

Der Lizenznehmer darf die Web-Fonts nur mit der herkömmlichen @font-face CSS-Deklaration verwenden. Es dürfen keine anderen Technologien wie sIFR, Cufon oder Typeface.js verwendet werden, um die Schriftarten bereitzustellen oder anzuzeigen.

Die Verwendung der Web-Fonts beschränkt sich auf die Verwendung in Websites. Wenn Sie die Web-Fonts oder die Designs, die die Web-Fonts enthalten, in Software, Hardware, mobile Apps, Anwendungen, Geräte oder jede Art von eigenständiger Software/Hardware einbetten oder einbeziehen möchten, ist eine zusätzliche Lizenzierung erforderlich. Hierfür kontaktieren Sie bitte die Revolver Type Foundry.

Wenn Sie sich nicht sicher sind, ob Ihre Nutzung der Web-Fonts im Rahmen dieser Vereinbarung ausdrücklich erlaubt ist, wenden Sie sich bitte an die Revolver Type Foundry.
